General Terms and Conditions (GTC)

1. Scope of Application
(1) All contracts concluded via the online shop www.birkenspanner.com between the customer and BioCraft Naturprodukte GmbH, Bahnhofstraße 18, 70734 Fellbach, Germany, registered in the commercial register of the Amtsgericht Stuttgart under HRB 803334, represented by the managing director Alexander Kögel (hereinafter referred to as "Seller"), are exclusively subject to the following General Terms and Conditions (GTC).
(2) Deviating conditions of the customer will not be recognized unless the Seller expressly agrees to their validity in writing.
(3) The current version of the GTC can be viewed on the website at any time. During the ordering process, the customer has the opportunity to view, print and save them.

2. Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to order.
(2) By clicking the order button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
(3) The contract is concluded as soon as the Seller confirms the order by an order confirmation via e-mail or ships the goods.

3. Prices and Shipping Costs
(1) All prices in the online shop are final prices and include the statutory value-added tax.
(2) In addition to the stated prices, shipping costs may apply. These will be clearly displayed during the ordering process.

4. Delivery
(1) Delivery will be made to the delivery address specified by the customer.
(2) Delivery times are stated in the respective product offer.
(3) If a product is temporarily unavailable, the customer will be informed immediately.
(4) For consumers, the risk of accidental loss or damage to the goods during transport passes to the customer only upon delivery of the goods.

5. Terms of Payment
(1) Payment is made via the payment methods offered in the online shop. The respective available payment methods are displayed during the ordering process.
(2) The Seller reserves the right to exclude certain payment methods or to offer only certain payment methods in individual cases.

6. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal.

Instructions on Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you took possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
For this repayment, we will use the same means of payment that you used for the original transaction.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods.
The customer must return the goods without undue delay and in any event not later than fourteen days.

Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

7. Return Costs
(1) In the event of a statutory withdrawal, the customer generally bears the direct costs of returning the goods.
(2) The Seller bears the costs of return if
the delivered goods are defective
an incorrect delivery has occurred
the value of the goods ordered exceeds 25 Euros.
(3) For goods with a value under 25 Euros, the customer bears the costs of return, unless there is a defect or an incorrect delivery.
(4) Returns should be registered with customer service in advance.

9. Transport Damage and Lost Shipments
(1) If goods are delivered with obvious transport damage, the customer is asked to report such damage to the delivery agent immediately if possible and to inform the Seller.
(2) Failure by the customer to make such a report does not affect their statutory warranty rights.
(3) Should a shipment be lost in transit or cannot be delivered, the Seller will arrange for a replacement delivery or refund.

10. Warranty
The statutory warranty rights apply.

11. Liability
(1) The Seller is liable without limitation for intent and gross negligence.
(2) In cases of slight negligence, the Seller is only liable for the breach of essential contractual obligations.
(3) Liability for damages resulting from injury to life, body or health remains unaffected.

12. Information on Cosmetic Products
(1) The products offered are cosmetic products within the meaning of the EU Cosmetics Regulation and are exclusively intended for external use.
(2) Individual skin reactions cannot be ruled out. It is recommended to test the product on a small skin area before first use.
(3) If known allergies to individual ingredients exist, the products should not be used.
(4) The provided product information does not replace medical or dermatological advice.

13. Retention of Title
The goods remain the property of the Seller until full payment.

14. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution:

The Seller is not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.

15. Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
